On November 14, 2014, the Honorable William H. Pauley III entered an order scheduling a February 13, 2015 fairness hearing and directing that notice of the Futures Plaintiffs’ proposed settlement with the sole remaining non-settling defendant MF Global, Inc. be provided to the Futures Class. The proposed settlement provides for a cash payment of $4,672,500 and an allowed claim in the MF Global bankruptcy proceeding of $18,753,571.43. The proposed settlement with MF Global is separate and in addition to the Futures Plaintiffs’ $48,400,000 proposed settlement with the Moore Capital Defendants and Defendant Joseph Welsh. Futures Class members need only file a single proof of claim in order to seek to participate in both the proposed settlement with MF Global and the proposed settlement with the Moore Capital Defendants and Defendant Joseph Welsh.
