On February 14, 2014, the Honorable Robert W. Sweet denied the motion by NASDAQ for permission pursuant to 28 U.S.C. § 1292 (b) to appeal the denial of its motion to dismiss claims that NASDAQ failed to follow its rules and negligently failed to properly test and design its systems in connection with the Facebook IPO.
